This is a compelling opportunity to join ASIC's Criminal Law Team within Legal Services, where you will provide specialist legal advice on complex criminal investigations and prosecutions involving serious corporate and white‑collar crime.

The team
Legal Services plays a critical role in delivering ASIC's regulatory, enforcement and litigation functions and is instrumental in maintaining ASIC's reputation as a modern, effective and outcomes‑focused regulator.
The Criminal Law Team provides expert advice and assistance on all aspects of ASIC's criminal investigations and prosecutions, including the use of statutory information‑gathering powers, development of briefs of evidence, and engagement with the Commonwealth Director of Public Prosecutions (CDPP). The team also contributes to legislative reform and policy development relating to criminal law, procedure and enforcement powers.
The role
As a Senior Lawyer (EL2), you will provide specialist legal advice on criminal investigations and prosecutions arising from ASIC's enforcement work. You will work closely with investigators and the CDPP on complex, high‑profile matters involving serious corporate and financial crime.
You will be required to:
- Provide expert legal advice to multi‑disciplinary investigation teams on criminal investigations, prosecutions and the use of ASIC's information‑gathering powers
- Advise on the sufficiency of evidence and preparation of briefs of evidence for referral to the CDPP
- Collaborate closely with the CDPP on complex criminal prosecutions, including sentencing hearings and appeals
- Assist ASIC in‑house prosecutors with summary prosecutions conducted under CDPP consent
- Conduct pre‑brief and early guilty plea negotiations to support timely and effective resolution of matters
- Draft high‑quality legal advice and research on complex criminal law, evidentiary and procedural issues
- Contribute to the development and review of criminal law policies, practices and legislative reform initiatives
- Manage a significant and complex caseload independently, with guidance from the Special Counsel – Criminal Law as required
- Support capability building, innovation and continuous improvement within Legal Services
- Mentor, coach and support junior lawyers and contribute to a positive, high‑performing team culture
As an EL2, you are accountable for delivering high‑quality outcomes, exercising sound judgement, managing risk, and contributing to the leadership and capability of the Criminal Law Team.
About you
To succeed in this role, you will bring:
- Admission to practice in an Australian jurisdiction and eligibility to hold a Restricted Government Legal Practising Certificate
- Significant experience in complex criminal investigations and enforcement matters, particularly white‑collar, corporate or financial crime
- Strong knowledge of criminal law and procedure, including the rules of evidence
- Demonstrated experience managing major criminal matters and engaging effectively with prosecuting authorities
- Excellent written, verbal and interpersonal communication skills, with the ability to influence and advise senior stakeholders
- Strong judgement, resilience and the ability to manage competing priorities in a fast‑paced environment
Highly desirable experience includes:
- 7–10 years' post‑admission legal experience
- Experience as a Prosecutor, particularly in fraud or complex financial crime matters
- Experience working with, or within, the CDPP or another prosecuting authority
- Experience in a regulatory, enforcement or public sector environment
